    What if the temp hadn't been an issue, but the kid had choked on the nugget and died while eating unsupervised? Would the mom have been held responsible for negligence?

    My mom never just handed us food in the car like that, and it's common sense that one should have a reasonable expectation that fresh food would be hot.

    How was the McDonalds corporation found liable for the kid dropping the nugget and burning herself? McDonalds didn’t drop the food or hand it to the kid. McDonalds is not responsible for raising your children.

    Curiously, this reminds me of 2008 housing crisis. Everyone was up in arms about banks making easy loans. Almost no one talked about people buying $1M houses with minimum wage income.
    Unfortunately we live in litigious society. Its easy to play victim than accept responsibility. And more lucrative too.

    This isn't a new thing though. The McDonald's hot coffee lawsuit was like 30 years ago now. If I remember correctly, that person's burns were a little more serious, but still along the same lines.

    Love some of these statements:

    "...failure to warn customers about the risk of hot food" - maybe they hadn't experienced hot food before.
    "...failing to provide instructions for safe handling of the food" - same.
    "...took photos on her iPhone, which included audio clips of the child's screams" - really, that was the first reaction? No ice or cool beverage was applied? I'm assuming here that a cold beverage of some type was purchased.
    "...nuggets were not meant to be pressed between a seat belt and human flesh for more than two minutes" - great response from McD.
    "...the family's lawyers argued the temperature was above 200 degrees (93 Celsius), while the defense said it was no more than 160 degrees (71 Celsius)" - McD has legs to stand on based on their standard practice of preparation. Family's lawyers have no data to support any temperature they claim existed.

    And this event happened FOUR YEARS AGO?

    Ridiculous....

    When i picked up a hot coal from my dads BBQ as a kid we didn't sue the charcoal manufacturer, even when I did it a second time. lol It was a lesson for all, not a license to sue someone for my/our stupidity.

    What did this Mom do when she gave her baby a hot bottle, or fully cooked food for the first time? How did this kid make it out of infancy?

    We are all doomed.....

    I pray for an EMP every day.

    Do we at least have the audio of her screaming?

    I remember when I was really young, 1st grade, and sitting in the back of my parents Dodge Colt. My mom would give us hot fries from McD and we would hang them out the window to cool down.

    Thanks again for bringing this to my attention. I won’t eat a subway sandwich wrapper again. Besides the wrappers that are on McDonalds hamburgers don’t say that and they are much tastier.

    Mom certainly didn't care for the child. A case could be made for child endangerment / or even abuse?
